We trade as perfumeoasis.co.uk. Throughout the site, the terms “we”, “us” and “our” refer to Orchid Trading Group Limited.

These Terms apply to orders placed on perfumeoasis.co.uk. Orders placed on our European storefronts (perfumeoasis.es, perfumeoasis.de, perfumeoasis.fr and perfumeoasis.it) are sold and fulfilled by Oasis de Belleza SL and are governed by the terms published on those sites.

We offer this website, including all information, tools and services available from it, conditioned upon your acceptance of all terms, conditions, policies and notices stated here. By visiting our site or purchasing something from us, you engage in our “Service” and agree to be bound by these Terms of Service, including the additional terms and policies referenced here or available by hyperlink. Please read them carefully. If you do not agree to them, you may not access the website or use any of our services.

Any new features or tools added to the store are also subject to these Terms. We reserve the right to update, change or replace any part of these Terms by posting updates to our website. Our store is hosted on Shopify Inc., which provides the e-commerce platform that allows us to sell our products to you.

We may refuse service to anyone, for any lawful reason, at any time. You understand that your content (excluding payment card information) may be transferred unencrypted and may involve transmission over various networks and changes to conform to technical requirements. Payment card information is always encrypted in transit.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service without our express written permission. Headings are included for convenience only and do not limit or affect these Terms.

Section 3 — Accuracy, Completeness and Timeliness of Information

We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied on as the sole basis for making decisions. Any reliance on the material is at your own risk.

This site may contain historical information which is not current and is provided for reference only. We may modify the contents of this site at any time, but we are under no obligation to update any information on it.

Section 4 — Modifications to the Service and Prices

Prices for our products are subject to change without notice. We may modify or discontinue the Service, or any part of it, without notice. We will not be liable to you or any third party for any modification, price change, suspension or discontinuance of the Service. Where you have already placed an order and we accept it, the price confirmed to you at that point is the price that applies.

Section 5 — Products or Services

Certain products may be available exclusively online. These may be limited in quantity and are subject to return or exchange in accordance with our Return Policy. We have made every effort to display the colours and images of our products as accurately as possible, but we cannot guarantee that your screen's display of any colour will be accurate.

We may, but are not obliged to, limit sales of our products to any person, geographic region or jurisdiction, and to limit quantities. All product descriptions and prices are subject to change at any time without notice.

Section 6 — Returns, Refunds and Your Cancellation Rights

Our full returns process is set out in our Return Policy. In summary, you may return eligible items within 30 days of receiving your order. To receive a refund, the item must be returned to us — refund requests made without returning the item will be rejected.

Separately from our 30-day policy, you have a statutory right under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 to cancel most online purchases within 14 days of receiving the goods, and a further 14 days to return them. This right does not apply to sealed goods which are not suitable for return for health protection or hygiene reasons if the seal has been broken after delivery.

For that reason, fragrances and cosmetics must be returned unused, unopened and sealed in their original packaging, unless the item is faulty, misdescribed or you received the wrong product. Once we receive the returned item, we will issue your refund within 2 days to your original payment method.

Nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015, including your rights in respect of goods that are faulty, not as described or not fit for purpose. Please contact us to start a return before raising any payment dispute or chargeback.

Section 7 — Accuracy of Billing and Account Information

We reserve the right to refuse any order you place with us. We may limit or cancel quantities purchased per person, per household or per order, including orders placed under the same customer account, payment card, or billing or shipping address. We may limit or prohibit orders that, in our reasonable judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases, and to update that information promptly so that we can complete your transactions and contact you as needed.

Section 8 — Optional Tools

We may provide access to third-party tools which we neither monitor nor control. You acknowledge that we provide access to such tools “as is” and “as available” without warranties, representations or conditions of any kind and without endorsement. Any use of optional tools offered through the site is at your own risk.

Content and services available through our Service may include material from third parties, and third-party links may direct you to sites not affiliated with us. We are not responsible for examining or evaluating their content or accuracy, and we accept no liability for third-party materials or websites. Section 12 — Errors, Inaccuracies and Omissions

Occasionally there may be information on our site that contains typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, offers, shipping charges, transit times or availability. We may correct any errors, inaccuracies or omissions, and change or update information or cancel orders where information is inaccurate, at any time and without prior notice, including after you have submitted your order. Where we cancel an order for this reason after you have paid, we will refund you in full.

Section 13 — Prohibited Uses

In addition to other prohibitions set out in these Terms, you are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or take part in unlawful acts; (c) to breach any international, national or local regulations, rules, laws or ordinances; (d) to infringe our intellectual property rights or those of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate or discriminate; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other malicious code; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent the security features of the Service. Subject to the paragraph above, Orchid Trading Group Limited and our directors, officers, employees, affiliates, agents, contractors, suppliers, service providers and licensors will not be liable for any indirect, incidental, special or consequential loss arising from your use of the service or any products purchased through it. Our total liability in connection with any order will not exceed the amount you paid for that order.

Section 15 — Indemnification

You agree to indemnify and hold harmless Orchid Trading Group Limited and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers and employees from any claim or demand, including reasonable legal fees, made by any third party arising out of your breach of these Terms or your violation of any law or the rights of a third party. This does not apply to consumers acting outside the course of a business.

Section 16 — Severability

If any provision of these Terms is determined to be unlawful, void or unenforceable, that provision will nonetheless be enforceable to the fullest extent permitted by law, and the unenforceable portion will be severed. This will not affect the validity and enforceability of the remaining provisions.

Section 17 — Termination

Obligations and liabilities incurred before the termination date survive termination of this agreement for all purposes. These Terms are effective unless and until terminated by either you or us. If you fail, or we reasonably suspect you have failed, to comply with any provision of these Terms, we may terminate this agreement without notice and you will remain liable for all amounts due up to and including the date of termination.

Section 18 — Entire Agreement

Our failure to exercise or enforce any right or provision of these Terms does not constitute a waiver of that right or provision. These Terms and any policies posted by us on this site constitute the entire agreement between you and us and govern your use of the Service.

Section 19 — Governing Law and Jurisdiction

These Terms and any separate agreements under which we provide you services are governed by and construed in accordance with the law of England and Wales, and you and we submit to the non-exclusive jurisdiction of the courts of England and Wales. If you are a consumer resident elsewhere in the United Kingdom, you may also bring proceedings in the courts of your home nation.
